REASONS FOR DECISION

[1] This is an application pursuant to s.23 of the Industrial Relations Act 1984, made by The Tasmanian Independent Schools Teachers Association (the Association) and lodged on 24 February 2003.

[2] Mr R Mecklenburgh, for the Association, indicated that the application sought to vary the Independent Schools (Teachers) Tasmania Award to restore Clause 4 - Due Process to that which applied at the time the award was restructured and consolidated.1 He said the change was never the intention of the parties during the award review process and has occurred inadvertently by an oversight.

[3] Ms J Thomas for the Tasmanian Chamber of Commerce and Industry Limited supported the submission of Mr Mecklenburgh.

[4] Given the submissions of the parties and the degree of consent, I approve the variation to the award in the manner sought in the draft Order attached to the application. The variation shall come into operation on and from 4 March 2003.

[5] The Order giving effect to this decision is attached.
