TASMANIAN MUSHROOMS AGREEMENT 2004

REASONS FOR DECISION

(1) On 14 October 2003 The Australian Workers' Union, Tasmania Branch and Adelaide Mushrooms (Nominees) Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tasmanian Mushrooms Agreement 2003.

(2) When this matter came on for hearing on 18 October 2004, Mr I Wakefield appeared for union and Mr S Cornish, of the Tasmanian Chamber of Commerce and Industry Limited, appeared for the employer.

(3) Mr Cornish advised that this Agreement replaces the 2003 Agreement approved on 18 September 2003.1 Apart from the application of the 2004 State Wage decision, there has been minimal change from the previous Agreement.

(4) Mr Wakefield supported the submission of Mr Cornish.

(5) I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

(6) Pursuant to s.55[4] of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 1 August 2004 and shall remain in force for a period of 12 months.

(7) The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
