REASONS FOR DECISION

[1] On 14 December 2004, the Minister Administering the State Service Act 2000, The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU), the Australian Education Union, Tasmanian Branch (AEU) and the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tasmanian State Service National Training Wage Agreement 2004.

[2] When this matter came on for hearing on 19 January 2005, Mr J Di Falco appeared for the Minister, Mr M Johnston appeared for the CPSU and Mr T Kleyn appeared for the HSUA. By facsimile dated 23 December 2004, Mr C Lane, of the AEU, notified the Commission that the AEU consented to the application, however, was unable to be represented at the hearing.

[3] Mr Di Falco explained that this agreement replaces the 2003 agreement.1 He outlined a number of changes including the inclusion of the 2004 State Wage Case decision and an increase in the maximum number of hours for school based traineeships from 800 to 900 per training course, per annum.

[4] Mr Kleyn and Mr Johnston supported the submissions of Mr Di Falco.

[5] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] Pursuant to s.55(4) of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 11 September 2004 and shall remain in force for a period of one year.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
