ELECTRICAL ENGINEERS AWARD

Award variation - wage rates - conditions - application approved - operative date 1 August 2005

REASONS FOR DECISION

[1] This is an application to vary the Electrical Engineers Award (the award).

[2] This application replaces a previous application which was before Deputy President Watling in matter T11013 of 2003. That application did not proceed and pursuant to s.21(2)(c)(iv) the proceedings in that matter will be discontinued.

[3] The application is made by consent between the Communications, Electrical, Energy, Information, Postal, Plumbing and Allied Services Union (CEPU) and the Tasmanian Chamber of Commerce and Industry (TCCI), both parties being named respondents to the award.

[4] The application "completely reviews and modernizes the award" which, it was submitted, had become "out of date and requiring modernisation" including updating the rates of pay which did not include recent State Wage increases.

[5] The proposed variations to the award are in `plain English' and comply with the wage fixing principles of the Commission and in particular principle 13, the Award Review principle. The application seeks to remove any obsolete provisions and the respondent parties clause has been varied to remove reference to the National Union of Workers in accord with a decision of Commissioner Watling, as he was then, in matter T4114 of 1992.

[6] The variations reflect several years of negotiations between the CEPU and the TCCI and makes the award consistent, as far as is necessary and possible, with the National Electrical, Electronic and Communications Contracting Industry Award 1998, an award of the Australian Industrial Relations Commission.

[7] The operative date for the award will be the first full pay period on or after 1 August, 2005. The award includes increases provided by the 2005 State Wage Case decision.

[8] The award variations are not contrary to the provisions of the Industrial Relations Act and it is the public interest for the award to be up to date and relevant to the employers and employees party to its provisions.

[9] The award will be varied in accord with the agreed draft document tendered.
