Variation of registered industrial agreement T13071 of 2007 – Nurse Practitioner – application approved – operative date 1 December 2008

 

REASONS FOR DECISION

 

[1] On 15 December 2008, the Australian Nursing Federation Tasmanian Branch (ANF), the Health Services Union of Australia, Tasmania No. 1 Branch (HSU1) and the Minister administering the State Service Act 2000 (MASSA) lodged with the Registrar, pursuant to Section 59 of the Industrial Relations Act 1984, an application to vary the Nurses (Tasmanian Public Sector) Enterprise Agreement 2007. The application sought to recognise the new classification of Nurse Practitioner within the agreement.

[2] When this matter came on for hearing on 17 December 2008, Ms S Goldfinch appeared for HSU1. Ms N Ellis appeared for the ANF and Mr R Hitchcock appeared for MASSA.

[3] All of the above parties gave submissions in support of the application.

[4] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[5] Pursuant to s.59(2) of the Act, the variation to the agreement is approved operative from 1 December 2008.

[6] An Order giving effect to the variations is attached.
