Award variation – new Appendix 9 – Tasmanian Fire Service – award consolidated – operative date 17 March 2009


REASONS FOR DECISION


[1] On 5 March 2009, an application was lodged by the Minister administering the State Service Act 2000, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Tasmanian State Service Award.  The application sought to add a new Appendix 9 – Special Provisions for Employees of Tasmanian Fire Service.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 16 March 2009.  At the hearing Mr P Baker appeared for the Minister administering the State Service Act 2000.  Ms K Jackson appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. with Mr P Horne.  Both of the above gave oral submissions in support of the application.

[3] I am satisfied that the variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act.  The variation is made with the consent of the Tasmanian Trades and Labor Council.

[4] The order reflecting this decision, with an operative date of 17 March 2009, is attached.
