Variation of registered industrial agreement T13334 of 2008 - application to vary approved - operative from ffpp 1 March 2009 - to remain in force until 20 October 2011


REASONS FOR DECISION

[1] On 5 March 2009, the Australian Education Union, Tasmanian Branch (the AEU) lodged with the Registrar, pursuant to Section 59 of the Industrial Relations Act 1984, an application to vary the Post Year 10 Teaching Staff Industrial Agreement 20091.

[2] When this matter came on for hearing Mr C Lane appeared for the AEU; Mr P Baker, Mr M Watson, Mr P Gourlay, Ms J Fitton and Ms D Crespan appeared for the Minister.

[3] The parties advised that the application sought to vary: Schedule 1 - Salaries in the agreement, with an operative date of the first full pay period on or after 1 March 2009 and to remain in force until 20 October 2011.

[4] Mr Watson, for the Minister, concurred with the submission of Mr Lane.

[5] I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[6] Pursuant to s.59(2) of the Act, the variation to the agreement is approved operative from the first full pay period  on and from 1 March 2009.

[7] An Order giving effect to the variation is attached.
