RECORD OF OUTCOME OF APPLICATION [Recommendations]


On 17 April 2009, an application was lodged by the Minister administering the State Service Act 2000, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Nurses (Tasmanian Public Sector) Award 2005 re sick leave.

A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 27 May 2009.  At the hearing Mr P Baker appeared for the Minister for Justice and Workplace Relations.  Ms C Saint appeared for the Australian Nursing Federation Tasmanian Branch and Mr T Jacobson appeared for the Health Services Union of Australia, Tasmania No. 1 Branch.  

After hearing preliminary submissions associated with the application, the hearing was adjourned until 18 June 2009.  However on 17 June 2009 Mr Baker wrote to the Commission advising that:

“The Minister administering the State Service Act 2000 hereby withdraws the application to vary the Nurses (Public Sector) Award and instead will issue an appropriately worded circular to nursing staff reminding them of their award obligations.”

In view of the above and pursuant to the provisions of Section 21(2)(c) of the Industrial Relations Act 1984, the matter is discontinued and the file is closed.
