Variation of registered industrial agreement T13417 of 2009 – application to vary approved - operative from ffpp 1 April 2009 – to remain in force until 30 September 2013


REASONS FOR DECISION


[1] On 10 July 2009, the Minister Administering the State Service Act 2000 and the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch, (the LHMU) lodged with the Registrar, pursuant to Section 59 of the Industrial Relations Act 1984, an application to vary the Education Facility Attendant Job Security Industrial Agreement 2008.1

[2] When this matter came on for hearing Ms S Griffiths appeared for the LHMU and Ms S Haas appeared for the Minister.

[3] The parties advised that the application sought to vary: Clauses 6, 8 and 12 in the agreement, with an operative date of the first full pay period on or after 1 April 2009 and to remain in force until 30 September 2013.

[4] Ms Griffiths concurred with the submissions of Ms Haas.

[5] I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[6] Pursuant to s.59(2) of the Act, the variation to the agreement is approved operative from the first full pay period on and from 1 April 2009.

[7] An Order giving effect to the variation is attached.
