REASONS FOR DECISION


[1] This application, lodged pursuant to s.59(2) of the Industrial Relations Act 1984 by the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch, (the union), was for the purpose of filing a variation to an industrial agreement with the Commission.

[2] A hearing commenced in Hobart on 19 November 2010.

[3] The agreement, known as the Education Facility Attendant Salaries and Conditions of Employment Industrial Agreement 2008 is varied with respect to Clause 7- Classification and Wage Structure.

[4] Mr P Tullgren, for the union, and Ms D Crespan, for the Minister, (Department of Education), presented submissions in support of their consent application.

[5] Having considered the consent submissions of the parties, I am satisfied the variation is consistent with the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[6] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.

[7] The Order giving effect to this decision is attached.
