Industrial agreement – application approved – operative date from date of registration until 30/6/13– forwarded to Registrar for registration

DECISION

[1] On 22 June 2012, the Minister administering the State Service Act 2000 (MASSA) The Community and Public Sector (SPSFT) Inc. (CPSU) and the Australian Workers’ Union, Tasmanian Branch (AWU) lodged, pursuant to Section 55(2) of the Industrial Relations Act 1984, (the Act), the Department of Primary Industries, Parks, Water and Environment Industrial Agreement 2012.

[2] At the hearing on 2 July 2012 Mr M Johnston appeared for the CPSU and also for the AWU.  Mr K Grey appeared for MASSA.

[3] Mr Johnston explained that the purpose of this agreement was to extend the application of the Purchased Leave Scheme (PLS) to certain employees covered by the AWU (Tasmania State Sector) Award and the Parks and Wildlife Industrial Agreement 2009 who are employed in the Department of Primary Industries, Parks, Water and the Environment.

[4] Mr Grey supported the submissions of Mr Johnston.

[5] I am satisfied that the agreement is consistent with the public interest requirements of the Act and does not disadvantage the employees concerned.  Pursuant to s55(4) of the Act the agreement is approved operative the date of registration and shall remain in force until 30 June 2013.

[6]  The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
