IN THE MATTER OF AN APPLICATION BY THE TASMANIAN PUBLIC SERVICE ASSOCIATION TO VARY THE PORT ARTHUR AUTHORITY AWARD

RE: KILOMETREAGE RATES

COMMISSIONER P A IMLACH

HOBART, 15 December 1989

REASONS FOR DECISION

APPEARANCES:

For the Tasmanian Public Service Association

- Mr K Grey

For the Port Arthur Historic Site Management Authority

- Mr J McCabe

DATE AND PLACE OF HEARING:

11 December 1989  Hobart

This application, by the Tasmanian Public Service Association, is for the "kilometreage" rates specified in the Port Arthur Authority Award to be increased retrospectively in line with movements in the same kind of provisions in the General Conditions of Service Award. More particularly the increases sought relate to the Australian Bureau of Statistic's Consumer Price Index (CPI) increases for the March 1989 and September 1989 quarters. Such increases have already been applied in the General Conditions of Service Award1.

Mr Kerryl Grey, appearing for the Tasmanian Public Service Association (TPSA) advised that the parties had intended from the beginning that the "kilometreage" rates specified in the Port Arthur Authority Award would be amended from time to time as and when the same rates were amended in the General Conditions of Service Award. Mr Grey, at the beginning of the hearing sought and was granted, leave to amend the Association's application to reflect the two CPI movements claimed (the original application only mentioned one of the CPI movements).

For the record, the details of the amendment sought by Mr Grey were:

1.  From the beginning of the first full pay period commencing on or after 29 August 1989 and Correction Order:

Annual Kilometreage Travelled
on Duty in a Financial Year

Cents per Kilometre

RATE 1
(2 litres & above)

RATE 2
(less than 2 litres)

     First 10,000 kilometres

28.94 (100%)

24.89 (86%)

     Any additional kilometres

15.34 (53%)

13.31 (46%)

2.  From the beginning of the first full pay period commencing on or after 7 November 1989 and Correction Order:

     First 10,000 kilometres

30.02 (100%)

25.82 (86%)

     Any additional kilometres

15.91 (53%)

13.81 (46%)

Mr John McCabe, appearing for the Chairman of the Port Arthur Historic Site Management Authority, confirmed Mr Grey's advice and said that the Authority was agreeable to the Association's application and to the operative dates sought.

As I indicated at the hearing, in view of the agreement between the parties and the direct link between the two awards in this matter, the application is granted. Orders are attached.
