Award variation - Clause 6 - Parties and Persons Bound - delete all reference to The Association of Professional Engineers & Scientists, Australia, Professional Engineers Branch, Tasmania - insert The Association of Professional Engineers, Scientists and Managers, Australia - award varied - operative 21 June 1994

REASONS FOR DECISION

This was an application by The Association of Professional Engineers, Scientists and Managers, Australia (APESMA) to vary the Parties and Persons Bound clause of three awards, i.e.:

1. General Conditions of Service Award

2. Professional Engineers Award

3. North West Regional Water Authority Award

The alteration sought was to delete the name of The Association of Professional Engineers and Scientists, Australia, Professional Engineers Branch, Tasmania, and to insert the name of the applicant.

Reasons for the variation include the fact that a Full Bench de-registered the former organisation and by further decisions award interest was granted1 to the APESMA following its registration2.

Thus the name change to the three awards concerned is now largely procedural, and for these reasons the applications are approved and the awards will be varied in the manner requested.

Operative Date

The foregoing amendments shall take effect on and from the agreed date of 21 June 1994.

The Orders giving effect to this decision will be drawn by the members of the Commission, who have within their assignment, the respective awards that were the subject of this hearing.
