TASMANIAN PRISON SERVICE CORRECTIONAL ALLOWANCE AGREEMENT 2007

REASONS FOR DECISION

[1] On 7 June 2007, the Minister administering the State Service Act 2000, The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) and the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch (LHMU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tasmanian Prison Service Correctional Allowance Agreement 2007.

[2] When this matter came on for hearing on 14 June 2007, Mr N McCulloch appeared for the Minister, and Mr M Johnston appeared for the CPSU and, with written authority, for the LHMU.

[3] Mr Johnston explained that with the making of the Correctional Officers Agreement 20051 the parties had agreed that employees classified as Utility Officer and Industry Supervisor were more appropriately covered by the Operational Employees Award.

[4] This agreement provides for the payment of a corrections allowance of either 7.5% or 3.75%, depending on the nature of contact with inmates.

[5] Mr Johnston submitted that the level of the allowance had been struck having regard for similar allowances in inter-state jurisdictions and other agencies in the State service.

[6] Mr McCulloch supported the submissions of Mr Johnston.

[7] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and does not disadvantage the employees concerned.

[8] Pursuant to s55(4) of the Act, the agreement is approved operative from 1 July 2005 and shall remain in force for a period of three years.

[9] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
